Lakeside Castlegar Cabins Policy: Activity and Use of property Waiver & Release Lakeside Castlegar Cabins operated by Demon Marine Innovations Ltd. of 1065 B X Rd, Vernon, BC V1B 3K2, Canada (the "Activity/Property Provider") IN CONSIDERATION OF the covenants and agreements contained in this Agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties to this Agreement agree as follows:
Consideration

1. Being of lawful age and inconsideration of being permitted to participate in the activity described below, the Participant releases and forever discharges the Activity Provider, its owners, directors, officers, employees, agents, assigns, legal representatives and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the activity described below, and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of the Activity Provider.
2. The Participant understands that the Participant would not be permitted to participate in the activity described below unless the Participant signed this Agreement.
Details of Activity

3. The Participant will participate in the following activity: Short-term rental of any building(s) or property owned or rented by Lakeside Castlegar Cabins operated under Demon Marine Innovations Ltd. This is not limited to but can also include any form of recreational lake or property use, campfire use, driving on or from property of 4938 Broadwater Rd Robson, BC V0G1X0.
Concurrent Release

4. The Participant acknowledges that this Agreement is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives, and assigns.
Fitness to Participate
5. The Participant acknowledges that they do not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent the participant from participating in the above-mentioned activity.

If required, the Participant will obtain a medical examination and clearance.

The participant must disclose any medical condition to Lakeside Castlegar Cabins that may affect their participation in the above activities if they want to proceed with their rental/stay. Lakeside Castlegar Cabins is not liable for your inconvenience if we are not made aware of a condition.

Notification in writing of a medical condition that may affect the participants booking must be given at the time of signing this document. This will help us work with you to determine if this booking is right for you.
6. The Participant hereby acknowledges and agrees that they have carefully read this agreement, that the Participant fully understands the same, and that the Participant is freely and voluntarily executing the same.
7. The Participant understands that by signing this agreement, the Participant agrees to be forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for the above noted activity.
8. The Participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Agreement.
9. This Agreement contains the entire agreement between the parties to this agreement and the terms of this Agreement are contractual and not a mere recital. Governing Law
10. This Agreement will be governed by and construed in accordance with the laws of the Province of British Columbia.
Additional Terms of this Agreement and Cancellation Policy:

Up to 7 days prior to check in the participant will receive full refund. Up to 3 days prior to check in 50% refund.

Lakeside Castlegar Cabins is not liable nor will not provide a refund for any cancellation made due to “acts of god”, weather of any kind or animals and insects beyond our control. We will perform our due diligence to mitigate these issues but will not be held accountable for them. The participants’ refund is strictly given in accordance with the cancellation policy noted above.

Lakeside Castlegar Cabins is not Responsible for any lost, Stolen or Damaged Property or Personal Effects during your stay at the property

Prices subject to seasonal or promotional changes.
​
Full payment due at time of reservation.
​
Minors must be accompanied by an adult.
​
No smoking/Vaping inside cabin. $250 cleaning fee will apply. Charged to the credit card used in the booking.

Any garbage or personal effects that are abandoned on the property that are not contained in the bins provided inside the cabins will result in the credit card used for booking to be invoiced. Clean up of unnecessary disposal is at a fee of $100/hr plus dump and/or towing fees.

Free parking outside of cabin, if you have more than one vehicle please specify for more parking options.

During times of fire ban as regulated by the province of British Columbia or regulating authorities, there shall be no fires started or caused by any guest or their group members. The participant will bear all costs of fines, reparations, and punishments. Initial clean up costs start at $500 + any fines + any dumping fees. This will be charged directly to your credit card. Extra time spent, it will be invoiced to you at $100 hr. You will be provided an invoice for services.​

Quiet times on the property are from 11pm - 7am. You and those in your group will not disturb our neighbors or enter their property at any time.

Any broken or damaged property, buildings, tools or utensils that are owned of Lakeside Castlegar Cabins will be charged to the credit card that was used for purchase. You are liable for damage caused by those you have in your party or invite to visit with you on the property.

Racist, aggressive, or degrading behavior and/or criminal activity on the property will result in immediate removal from the property and RCMP will be notified if required. This will result in total loss of your booking and no refund will be provided.

Stand Up Paddle Board Rentals
​
To use paddleboards rented by Demon Marine Innovations Ltd. O/A Lakeside Castlegar Cabins the lessee and those who use it in their group acknowledge that it is MANDATORY to wear Buoyancy Devices i.e. Life Jackets at ALL times that meet Federal Canadian Marine and Coast Guard Standards
Lakeside Castlegar Cabins is not responsible for the following:

any defect of the paddleboard which may result in injury or death.

for any form of inappropriate or irresponsible use of Paddle boards

obstacles on land or water wherever the paddleboards are used that could cause injury or death

you, the lessee, waive Lakeside Castlegar Cabins of any liability that results in damage to property, personal injury or death

Fire Pit Rentals
​
The Lessee waives Demon Marine Innovations Ltd. O/A Lakeside Castlegar Cabins of all liability of any personal injury, death or property as a result of using the fire pit provided as well the propane tank provided.

Privacy Policy
​
All personal information provided to Lakeside Castlegar Cabins is in accordance with the Personal Information Protection Act of British Columbia. We do not share your information with anyone outside of this organization. If you have a question or concern/complaint. Please contact us directly at info@castlegarcabins.ca.
